Ray Madoff is a Professor at Boston College Law School where she teaches trusts and estates, estate and gift, tax, estate planning, and a seminar on immortality and the law. She is the lead author of Practical Guide to Estate Planning, and has written in a wide variety of areas involving property and death. Her new book, Immortality and the Law is a lively, engaging book dealing with topics that will be of interest to all readers, whether or not dynasty trusts and copyright terms are active concerns in their lives. This is the first book to look at how the law treats the interests of the dead in a comprehensive manner. Madoff explores rights of the American dead in comparison to those rights granted by other countries and also explores how American law regarding interests of the dead has changed over our country’s history. This exploration reveals: (1) that there is a distinctly American law of the dead, one that provides little protection for those interests we hold most dear, like our bodies and our reputations, but great protections for property interests (including recently commodified interests like the right of publicity); and (2) that there is a distinct trend in American law to grant greater and greater rights to the dead, and that this granting of rights to the dead is infringing on the rights of the living. Finally, the book shows how corporate interests are driving many of these changes—using the rights of the dead as a decoy to increase their profits
